Definitions

Terms used in these Terms and Conditions, unless expressly stated otherwise in the text of the Terms and Conditions, shall have the following meanings:

MBocharova – Mariana Bocharova, based in Lublin at 3/15 Hugo Kołłątaja Street, 20-006, conducting business under the firm MBocharova NIP: 8992998039, REGON: 529104394.

Rules and Regulations – these rules and regulations, available at https://vivasanpl.com , setting out the rules for the purchase of Goods offered by MBocharova on the https://mbocharova.com/ website, as well as telephone and e-mail orders

MBocharova Website, Site – the website available at https://mbocharova.com/ ,

User, Customer – any person (whether a natural person, a legal entity or an organizational unit without legal personality) using the Site.

Shopping Cart – a functional element of the Site that allows the Customer to make purchases through the website https://mbocharova.com/.

Merchandise - clothing, underwear, footwear, other textile products and accessories sold through the Site.

Terms and conditions for using MBocharova's services

Procedure for placing an order:

1. A prerequisite for accepting an order is prior reading and acceptance of these Terms and Conditions.
2. The Customer places an order through the website https://mbocharova.com/ ;
3. The prices of the Goods offered on the Site are placed next to the respective Goods. All prices provided on the Site are expressed in Polish zloty and are gross prices (including VAT). The binding and final price is the price of the Goods listed on the MBocharova Site at the time the Customer places the order.

Payment:

1. The Customer is obliged to pay for the ordered goods in the form of prepayment.
2. Failure by the Customer to make prepayment will result in MBocharova not proceeding with the order.
3. The Customer may pay the price of the goods to MBocharova by placing an order through the online store on the MBocharova Website.

Payment processing

The entity providing online payment processing for card payments is PayPro S.A.

Available forms of payment:

• Bank transfer,
• Payment cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro,
• BLIK

Time of order realization

Orders are fulfilled within the timeframe indicated when placing an order via the Site or within the timeframe agreed upon by MBocharova and the Customer. The execution of the Order cannot take place before the prepayment is made by the Customer.

MBocharova's Liability

1. MBocharov's liability for incorrect or defective execution of the Order shall be limited to the amount of the actual damage suffered by the Customer and shall not exceed MBocharov's remuneration for the execution of the Order in question. The above limitation shall not apply to a Customer who is an individual concluding a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional character for this person, arising in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.
2. In the event that it is not possible to fulfill the order at the time indicated on the site when placing the order on the Site, the Customer will be informed immediately. MBocharova will propose alternative dates for fulfillment of the Order. If none of the dates proposed by MBocharova suits the Customer, the Customer has the right to withdraw from the contract.

Withdrawal from the contract

The Customer, who is a natural person concluding a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional character for this person, resulting in particular from the subject of his/her business activity, made available on the basis of the provisions of the Central Register and Information on Business Activity, may withdraw from the concluded contract without giving any reason within 14 days from the date of placing and paying for the order. Withdrawal from the contract may be made by submitting a statement electronically to [email protected].

Refund of payment for the Goods

1. A full refund is available in the following cases:
   1. Cancellation of the contract by the Customer under the conditions provided for in these Regulations.
   2. Inability to complete the Order - we make a refund within 72 hours.
2. If there is a need for a refund for a transaction made by the customer with a payment card, MBocharova will make the refund to the bank account assigned to the customer's payment card.

Contact and Complaints

1. MBocharova shall exercise due diligence to ensure the proper level of operation of the Site. The User has the right to report concerns and errors in the functioning of the Site to: [email protected].
2. The user using the services has the right to submit complaints about the services to: [email protected].
3. Notifications and complaints should include a detailed description of the problem occurring and the Client's contact information to enable MBocharova to provide a response to the notification made by the User.
4. MBocharova may ask the User to provide additional information to the extent necessary to respond.
5. MBocharova will respond to the notification or complaint within 14 days of receiving the complete information.

Acting in accordance with Article 13(1) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (OJEU.L.2016 .119.1), hereinafter referred to as:“ RODO”, we would like to inform you that the Administrator of your personal data is Mariana Bocharova, based in Lublin at Hugo Kołłątaja 3/15, 20-006, doing business under the name MBocharova NIP: 8992998039, REGON: 529104394. Final provisions

1. Placing an order MBocharova is tantamount to acceptance of these terms and conditions.
2. The parties will endeavor to resolve any disputes arising from cooperation between the User and MBocharova amicably through negotiation.
3. The current text of the Terms and Conditions is published on the website https://mbocharova.com/ .
4. MBocharova reserves the right to make changes to the Terms and Conditions.
